Ecommerce Industries Pty Ltd (ACN 644 072 033) (t/a Ecommerce Equation) and Ecommerce Media Pty Ltd (ACN 648 640 439) (we, us, our or Ecommerce Group) respects your privacy and is committed to protecting your personal information as demonstrated in our Privacy Policy which tells you how we handle your personal information in accordance with applicable privacy laws.
1. About this Privacy Policy
This Privacy Policy applies to all personal information and personal data processed by us, including sensitive information (such as health information, or information about political opinions or associations, race or ethnicity or religious or philosophical beliefs). We do not actively request sensitive information about you. If at any time we need to collect sensitive information about you, unless otherwise permitted by law, we will first obtain your consent and we will only use it in accordance with applicable privacy laws. This Privacy Policy tells you how:
- we collect and manage your personal information;
- we use and disclose your personal information;
- we store and keep secure your personal information;
- we use cookies and web-tracking tools; and
- you can exercise your privacy rights.
We will update our Privacy Policy if the way we handle your personal information changes or as required by law.
2. How we collect and manage your personal information
Our website uses cookies to collect data about how you use our services, your preferences, browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. Generally, the data collected by cookies does not identify you. However, we may be able to identify you where you log into your account. Refer to section 7 below for more information on personal information in the context of cookies.
The personal information we collect will depend on how and why you engage with us, and may include the following:
- your name;
- your contact details, including email, social media account handle and phone number;
- details of the business that you represent or work for;
- your job title;
- images, videos and recordings of you, for example where you attend one of our member workshops or events;
- payment and transaction information, for example if you purchase a ticket to one of our events or become a member;
- your preferences and opinions, including about how we interact with you and our services;
- information you provide to us through our interactions with you, including as part of our services, through social media or our website and during our workshops and events;
- details of services we have provided or offered to you or that you have enquired about, and our responses to you, as well as information about your access and use of our services; and
- If you apply for a job with us, we collect information you include in your application, which could include your name, contact details, references and work experience.
Where you are a member, we will generally also collect details relating to the nature of your business, information and materials (including your intellectual property) provided by you to us in connection with the services you request (including training services).
Unlike Ecommerce Equation (which is an online coaching business that helps members develop the skills they need to market themselves), Ecommerce Media Pty Ltd is an agency that performs marketing services on behalf of the businesses it provides its services to. As such, Ecommerce Media Pty Ltd collects personal information that is additional to the above from these businesses, including information relating to a business’ clients (for example, an individual’s purchase history and other interaction-related information).
3. How we collect personal information
We generally collect personal information directly from you in the course of our dealings with you, such as when you:
- apply for or use our services;
- contact us with a comment, enquiry, complaint or for support services;
- attend or engage in our training programs, events, sales calls, workshops or seminars;
- access our website, mobile applications or social media platforms; and
- apply for a job with us or are onboarded as an employee.
In some circumstances, we may collect personal information about you from third parties or from publicly available information, including from:
- your employer, where you have been nominated as a member representative;
- the business that you have made a purchase from or otherwise interacted with, where that business is receiving services from Ecommerce Media Pty Ltd;
- if you apply for a job with us, the person(s) you nominate as your referee(s) for your application;
- our related businesses and third-party partners;
- our third party service providers, including IT, market research (including Lusha and Swordfish) and where competitions and promotions are run on our behalf; and
- information that is publicly available online.
You may also provide information to us about other individuals, such as when you nominate someone as an authorised representative on your account. In this case, you must inform those individuals that you are providing their personal information to us, and about our Privacy Policy.
4. How we use your personal information
We generally use your personal information for the primary purpose for which we collected it.
In the ordinary course of our business, and depending on the circumstances, we may also use your personal information to:
- carry out our general business operations;
- provide products and services to you, including for invoicing and order confirmation;
- market to you (such as providing you with information about promotional offers and details of our partners). See section 4.1 below for more information on direct marketing;
- receive reviews and testimonials;
- improve, tailor and further develop our products and services, and to improve our relationship with you; and
- contact you to respond to your queries or to provide information you have requested.
If you are a job applicant, we may use your personal information to assess and decide on your application, and to consider you for other job opportunities with us.
We may also use personal information to protect the security and integrity of our business, comply with legal requirements and obligations, or as otherwise permitted by law.
4.1 Direct marketing
We may use your personal information, including your contact details, to provide you with information we think will interest you about our products and services. This may include contacting you by SMS, post, email, telephone, our websites and mobile applications, and through social media. In every instance, we will ensure that our direct marketing material incorporates an option for you to elect to receive no further marketing communications.
At the point we collect personal information from you, you may be asked to “opt in” to consent to us using or disclosing your personal information. You may opt out at any time if you no longer wish to receive marketing information or do not wish to receive marketing information through a particular channel. You can make this request by following the unsubscribe option in a marketing message, or by contacting our Privacy Officer (contact details are below).
5. When might we disclose your personal information?
We generally only disclose your personal information to third parties where this disclosure is the primary purpose for which we collected it.
In the ordinary course of our business, and depending on the circumstances, we may also disclose your information to:
- related bodies corporate, including the entities that form part of the Ecommerce Group;
- third party service providers that help us conduct our business (including but not limited to technology service providers, data storage service providers, service providers that help us organise and run our events, our coaches and other experts);
- affiliate businesses and partners, with your prior consent and only to the extent necessary to enable the supply of relevant products or services;
- new or prospective owners or investors in our business, but only on the basis that the personal information is kept within the business;
- professional advisors and insurers, including our accountants, lawyers, auditors and our such advisors; and
- the public, where this is something that you have agreed to (e.g. where you provide a testimonial).
We may also disclose personal information where the law requires or authorises us to do so, or where this is at your direction or with your consent.
5.1 Disclosure to overseas recipients
Your personal information may be processed by or disclosed to our:
- employees, representatives, or other third parties based overseas who work for or are engaged by the Ecommerce Group, including but not limited to New Zealand and the United States of America where the Ecommerce Group operates; and
- service providers who are located in a number of different countries, including the United States of America, United Kingdom, European Union, New Zealand, Brazil, Vietnam and the Philippines.
Before your personal information is disclosed to an overseas recipient, we will take steps that are reasonable in the circumstances to ensure that the overseas recipient does not breach applicable privacy laws in relation to your personal information.
6. How we store and secure your personal information
We hold personal information electronically in our IT systems and databases which may utilise local and cloud technology in connection with the storage of personal information.
We take reasonable steps, including implementing organisational and technical measures, to protect the personal information we hold from misuse, interference and loss, and unauthorised access, modification or disclosure. These measures include the use of firewalls and encryption of member data during storage and transmission. We also take reasonable steps to destroy or de-identify personal information once we no longer require it to fulfil any valid or lawful purpose (which might include providing our products and services to you and investigating or managing any actual or potential claim, conflict or complaint.
Please contact us immediately if you become aware of a breach of security. If the personal information we hold about you is affected by a data breach, we will notify you and the Office of the Australian Information Commissioner where the loss, unauthorised access or disclosure is likely to result in serious harm to you.
To help us keep your personal information safe, please do not share your login details, preferences, unique reference details or any other information with any other person.
7. How we use cookies and data-tracking tools
We use cookies and web-tracking/analytic tools (including third-party tracking pixels) to collect and analyse information about how you interact with our websites, social media platforms and applications. Our cookies collect information such as IP or MAC addresses, the city associated with the IP or MAC address, the date and time of your visit to our website, pages viewed, the website you viewed before our website and the type of browser used.
7.1 Why we use cookies and similar technologies
Cookies and similar technologies allow our websites and applications to interact more efficiently with the device used and to help us improve the content and functionality of our websites and mobile applications. They also generate detailed statistics about traffic to our websites, how individuals interact with advertisements on our (and third party) websites, browsing and other activity, and can measure and record conversions and sales.
We use cookies, web tracking tools and similar technologies to help us present targeted and personalised advertising and other content about us on our (and third party) websites and mobile applications. This may also involve us working with third party service providers, advertisers and digital platforms that also use cookies and similar technologies to deliver this content to individuals.
8. Your right to access your personal information
You may request access to the personal information that we hold about you at any time from the Privacy Officer (contact details are below).
We aim to respond to your request within 30 days of you making a request.
We will provide you with access, unless an exception in the Privacy Act applies. If we refuse access, we will explain to you why.
We will not charge you for making a request to access your personal information, however if providing you with access is not straightforward, we may charge you a reasonable amount (which we will let you know about in advance) to cover the costs we incur retrieving your information and providing it to you.
9. Your right to request correction of your personal information
We take reasonable steps to ensure that the personal information which we collect, use or disclose is accurate, up-to-date and complete.
If you consider that personal information we hold about you is incorrect or requires updating, please contact our Privacy Officer (contact details are below).
We aim to respond to your request within 30 days of you making a request.
We are usually able to action your request. If we refuse your request, we will provide you reasons why. You can also ask us to associate a statement with the information about you that we hold indicating your disagreement with it.
